Do my clients still need to provide SBC’s?

Yes. Distributing a Summary of Benefits and Coverage to employees who are offered coverage through a group plan is still required. Not distributing SBC’s can lead to penalties of $1,000 or more per covered individual. SBC’s should be distributed by the employer:

  • With enrollment materials:
    • During each open enrollment for the plan that the individual is enrolled in (at a minimum).
    • For new employees added during the plan year.
  • Within 90 days after an individuals enrolls due to a qualifying event.
  • Within seven business days, if requested by an employee.
  • 60 days prior to a mid-year “material modification” of a plan.
