Effective October 1, 2022, the federal Centers for Medicare and Medicaid Services (CMS), is introducing a new broker mandate. If you or anyone on your staff communicate with Medicare-eligible individuals, read on.
The new rule requires brokers to add a disclaimer to communications related to CMS-regulated Medicare products, including in phone calls.
The required new disclaimer states: “We do not offer every plan available in your area. Any information we provide is limited to those plans we do offer in your area. Please contact Medicare.gov or 1-800-MEDICARE to get information on all of your options.”
In addition, the new rules require that broker phone calls related to CMS-regulated Medicare products be recorded.

California Agents & Health Insurance Professionals (CAHIP) is urging CMS to remove licensed and certified independent agents and brokers from the new requirement.

Launched July 16, 2022, the new National Suicide Prevention Lifeline (known as the 988 Suicide and Crisis Lifeline) is accessed by calling or texting the three-digit code 988. It’s available 24/7 for anyone who is suicidal or experiencing any type of mental health-related distress, including individuals who are worried about a loved one and need crisis support.
The National Suicide Prevention Lifeline – 800.273.8255 – will remain active, but calls will be routed to 988.
When people call or text the 988 lifeline, or chat via the Lifeline’s website, they’ll be connected to the existing network of more than 200 local crisis call centers around the country. Trained counselors will answer the phone, listen to the caller, understand how their problem is affecting them, provide support, and connect them to resources as needed.
Phone services are available in English and Spanish. Translation services are available for more than 250 additional languages.
The goal of the 988 Suicide and Crisis Lifeline is to make it easier for people to call for help, instead of dialing 911 and ending up in an emergency room waiting for hours, or interacting with law enforcement, which can lead to tragedy or trauma.
“Close to 90% of people who call get what they need from the phone call,” says Chuck Ingoglia, CEO of the National Council for Mental Wellbeing.

Anthem, Inc., the parent company of Anthem Blue Cross of California, has rebranded to Elevance Health, Inc.
Anthem Blue Cross of California and the other Elevance Health affiliated health plans are not changing their names. There is no impact to health plan member benefits, enrollment, or ID cards.
Elevance Health is also introducing a new Carelon brand to consolidate some other lines of business and will use its Wellpoint brand for its non-Blue Medicare, Medicaid, and commercial health plans. Learn more.

The COVID-19 pandemic has produced a huge increase in the demand for the treatment of mental health and substance use disorders. A new law – SB 221 – coming into effect July 1, 2022 aims to strengthen access to mental health services. Your clients may be interested in knowing the details.
Under existing law, California health plans must ensure their network of providers, including doctors, can provide enrollees with an appointment within a specific number of days or hours. Under the new law effective July 1, 2022, this requirement now extends to treatment for mental health and substance use disorders. You can find more background to the new law in a recent CaliforniaHealthline article. The California Department of Managed Health Care (DMHC) has also produced a Timely Access to Care fact sheet.

According to the newly released 2021 Transitions Opticals Workplace Wellness survey, employees are reporting more digital eyestrain as a result of increased screen time driven by new work routines and habits developed during the COVID-19 pandemic.
